Neighbor refusing treatment- we're on our 4th round!

Hello All:
I have been a frequent reader since our first bedbug discovery in Sept 08. We bought our co-op apartment in June 08. The bed bug problem was not disclosed, and we did not know to ask. The apartment above ours is a sponsor rental. In September the board had a mandatory inspection of our building, which found a serious infestation in the apartment above ours. We had just been treated and came up as negative, but we continued to have issues into October. The first company we used was cheap, and sprayed 4 times. We then had Assured come in to treat my infants room, with steam and hepa vac. We did not have any problems for 8-9 months. In the end of May I started to get bit again. We had 4 treatments from Green Earth, since I am concerned for my sons health and wanted "safe" products. They were very helpful and honest, but after 4 treatments I am still getting bitten, and now my son is getting bitten too. We have seem to have a mild infestation, as my bites are few, but regular, and we vacuum A LOT.
From what I know, my upstairs neighbor will not continue treatments because his mother is elderly and his teenage son has asthma, but perhaps they do not react to the bites. His apartment is extremely cluttered, which adds to the unlikelihood of total annihilation. What is my neighbor and his landlord's responsibility to the other tenants? Can someone be forced to treat their apartment? I know without his apartment being properly treated, we will be dealing with this for at least as long as we live here, but we own and we are stuck. Is there an effective maintenance program for someone in my situation?

I think however, at this time there is no legal protection in forcing another tenant to have their apt treated. There should be, but there isn't!

there might be a law in NYC. Hell's Kitchen NYC? in NYC landlords have to pay for treatment. he might be able to legally threaten that tenant with eviction if he doesn't allow entrance. but i feel bad for the guy cause of his situation (elderly folks and asthma). maybe if you offered to help the guy out? take elderly parent and son to the park while exterminator is there?
