Is it Legal for LL to Treat?

    Hi folks,

    My LL has been 'treating' a bed bug infestation in my apt and the one next to mine for 7 months. He's now mixing his own batch of Archer and Suspend, applying it himself.

    I'm desperately trying to find if this is even legal. Can someone direct me to a person, place or website to help me in this search?
    My state is Wisconsin

    as they regulate pesticide applications in Wisconsin. In NY it is not legal unless the landlord is a certified applicator and a registered pesticide business.

    Thanks so much Winston O. Buggy . Today I finally got some attention by calling the Wisconsin Dept. of Agriculture, pesticide liscensing & complaints. They did a very detailed intake and assured me a formal investigation will be done on this LL and his 'treatments'.

    In addition, he told me that a lot of this info is actually printed on the labels, i.e. "to be used outdoors" or if indoors just what rooms and what amounts. I'd been looking on the MSDS (Material safety Data Sheet) that was finally given to me by my LL after numerous requests. The MSDS was also helpful in that it stated several times that this pesticide is NOT to be used in places of high heat (like an entire apt filled with space heaters that my LL used in conjunction with the sprays) Apparently heat breaks down these chemicals creating toxic gases which was another concern of both myself and my doctor.

    It sounds like they did not answer the question of whether the landlord applying pesticides per se, without a license, is illegal in WI as it is in NY.

    This is important -- because even used within the guidelines of the MSDS, a NY landlord applying pesticides without being certified applicator and a registered pesticide business (as Winston notes) would be breaking the law.

    Quite right you are Nobugsonme. Seems the laws in Wi are very blurred regarding who can spray where. From the sounds of it, LLs can(?) spray pesticides in their buildings but that's where the line gets fuzzy. It has to do with what the label says, and if the LL is heeding the instructions as well as the MSDS or just going spray-wild. Also, whatever is being used MUST be posted in the halls or hand given to the tenant. So my LL has violated a couple of these laws already. Perhaps this is why the Dept of Ag. took the info and is doing an investigation.

    What puzzles me is I don't understand why the city Building inspectors cannot do more to help the tenant. In their 'eyes' or by-laws, the LL can use whatever they want, even if it has not helped at all for the past 7 months as is what's going on here. ;( I'm so tired of these agencies that are supposed to be there to maintain tenant rights trying to pass the buck to someone else. The system seems very weak in support of the tenant and quite biased in support of LLs. Doesn't make sense to me as a bed bug infestation affects the entire city, not just 1 LL or building.
