Eviction notice midway thru treatment

Hi folks,
I have no idea if anyone will have any thoughts on this, but Im going to put it out there incase. Last week, my landlord left a notice giving me ten days to get rid of all but two cats. Ok, so I own up to having more than the lease allows, but in my defense (?) Hes known about this for very nearly a year. I didnt plan on it (found my female was pregnant 2 mos after getting my male neutered) anyway... This morning, I had steroid injections in my spine for a chronic medical condition.. I came home, wrote my rent check and left it on the door knowing hed be by to get it tonight. He knocked, but Im too uncomfortable to get up if I dont have to, I just figured he'd call if he really had to talk to me.
Well, he did call me..asked why I left a check "if I have to be out by the 25th." I said you left the notice about the cats, it says ten days, why wouldnt I pay rent.. Long story short, there were TWO letters.. Having been very upset, I missed the eviction notice he left. I got up to go get the envelope he left, and found the eviction notice.. heres where I had to laugh.. It says hes evicting me for not complying with preps for the PCO to eradicate the bbs.. I did everything to the letter, including packing my stuff in the bags the LANDLORD left me. Everythings in the center of the rooms, bins packed and have lids as told, closets empty, fish tank taken down, everything. I called him back and asked what specifically I did not comply with..and he replied " I dont know. Thats what the exterminator said." This time, I admit, I did LOL and my next question was, "the same exterminator whos already done TWO treatments? And is retuning next Weds?" I asked again what I didnt comply with, he continued to tell me he didnt know. I told him I want a list of supposed non compliances in writing, thats when he really started screaming at me..call my lawyer, other such non sense.. I said im not calling your lawyer, but I DO want my rent check returned.. Yep, he took the check anyway...rich, huh?if its not in my hand at 9am tomorrow, I will be at my bank putting a stop payment on it.
I do have a question, or two.. Obviously, I would love nothing more than to move and be done with this sexist neandrathal..however, I have no desire to take these parasites with me (or I may well have just given a 30 day notice myself) I know others have had LL issues..anyone know if an eviction midway thru extermination process would hold? I need to do some research, and make some calls in the morning, but I cant see how these pieces add up. He gave the notices to my adult son, who has Autism, whom I have legal guardianship of, the eviction notice is signed only by LL ..its not a sealed court document, nor signed by a judge, nothing..and....did I mention, he TOOK THE CHECK anyway?? LOL I cant figure that out, but I know the sob wouldve cashed it had I not.insisted he return it.

Contact your local tenants' right organization. I don't recall your story, and I would advise you not to post the city you're in on the boards (unless it's a very big city, and even then, given your landlord's attitude, I would not do so if I were you.)
But find out what organization handles the rights of tenants in your area and talk to them ASAP.
Local laws vary widely about what landlords can and can't do, and you need advice from someone from the same city you're in.
You also might search the forum to see if other people have asked about advice about the rights of renters in your city before. Any previous threads about your city might have useful leads.
And, also, sorry about that. It sounds like a really awful day.

I can't improve on buggyinsocal's response,but I agee with everything she said. You definitely need a tenants' advice organization. You can usually find one using Google, for your city or region. Good luck and I hope you're able to work this out somehow.

Thank you, buggy and nobugsonme, for your reply and excellent advice. I did some searching and believe I found exactly who I need to help me with this, and will call them first thing this morning. This is very so similar to how he handled things 9 months ago when the apts across the hall and above me came up infested. One tenant was evicted, the other, believed to be the cause of all this, I am told snuck out in the middle of the night and vanished. He clearly is very ignorant in the matter of how to successfully eliminate bbs. If he stays true to form, that wont change.

Just an update.. I spoke with tenant advocate/legal assistant group a bit ago..an intake person will be calling me later today to advise me of my rights.. So, I feel a bit better, although cautiously optimistic. LL also did return my check this morning. Thank again for the help!

I'm glad things are moving forward. I hope they work out well for you.
Also, btw, you're right: evicting people with bed bugs isn't going to solve the problem.
I'm also hoping it's illegal where you live.
Keep us updated as well as you can (without posting any information that you think your landlord could use in a case against you) and understand that people are watching this thread and hoping that you get some justice in this situation in addition to freedom from bed bugs.

GOOD NEWS!!! (lol for a change) I spoke to an advocate yesterday who was very helpful, and tells me I have a better case than my LL ... I dont wanna say too much, but I am being referred for legal council..so, I wont have to deal with this alone. I think its going to work out favorably for me.
It really sucks that I now have to take on a second battle, in addition to the bbs, but it is what it is. I know what I need to do, and what my rights are..
