			<content:encoded><![CDATA[<p>A piece on Donald Trump&#8217;s new Trump International Hotel &#038; Tower in Dubai brings us a bed bug sighting <a href="http://www.observer.com/2008/heidi-heels-plus-trumps-say-no-bedbugs-new-dubai-dwelling">in the New York Observer&#8217;s Style section</a>:</p>
<blockquote>
<p>Which brought us to the host, developer Donald Trump. “The building is going to be something the likes of which has never been done before,” he said of the soaring, sailboat-style glass tower, which recalled to this reporter the Cooper Square Hotel now looming over the Bowery.</p>
<p>Donald Trump Jr., meanwhile, suggested the posh accommodations would be “very comparable to the best you have in New York, and vice versa.”</p>
<p>Any fear of bedbugs in Dubai? (See The Observer’s Summer Phobias report on page C1.)</p>
<p>“Everything’s brand new out there, so I’m sure they don’t have bedbugs,” his lovely wife, Vanessa, interjected.</p>
<p>“Most of it didn’t exist five years ago, so there’s probably not too much of an issue with bedbugs—and certainly not the places we’re staying,” the younger Mr. Trump said.</p>
<p>“No, you won’t have any—I promise,” Trump père said with a wink.</p>
<p>Phew!</p></blockquote>
<p>They probably don&#8217;t have any right now, if the place is brand new.  But then people move in and in time, even in the poshest environment, someone is going to bring in a bed bug.</p>
<p>As for the future, hopefully Mr. Trump has his bed bug prevention and management plan ducks in a row.</p>

Meanwhile, over in the Culture section of the same issue:</a></p>
<p>Among NewYorkers&#8217; summer phobias such as public urination, lightning, and bolting carriage horses, the Observer identifies a fear of picking up bed bugs:</p>

Speaking of Duane Reade, my girlfriend and I were there on a recent Saturday afternoon, buying a can of Pronto bedbug-killing spray. We’d just scored a couple of end tables at a sidewalk sale, and despite the fact the sellers lived in an immaculate brownstone, we couldn’t help shake the thought that any secondhand goods purchased in or around New York might be a vessel for those tiny, blood-sucking vermin that have induced psychological terror across the five boroughs.</p>
<p>How did it get to the point where some of us can’t even go to a flea market without worrying that it might have, well, actual fleas?
</p></blockquote>
<p>Um, well, maybe because it&#8217;s now <em>true</em> that they might have bed bugs!</p>
<p>Picking up bed bugs in an end table from a Park Slope stoop sale is <em>not </em>an irrational fear, and has got to be much more likely than being run down by a runaway horse in Central Park.<br />

<p>The article goes on to try and reassure us with the latest HPD statistics:</p>
<blockquote><p>
According to Neill Coleman, a spokesman for the Department of Housing Preservation and Development, it’s hard to assess the true threat. He said there’s been an increase in the number of bedbug complaints and violations over the past several years (in fiscal year 2004, HPD had 537 complaints, versus 8,840 complaints and 4,243 violations so far in fiscal year 2008, records show), but he also noted that bedbugs make up only a fraction of the more than 500,000 violations the department issues each year.</p></blockquote>
<p>There are over 16 times as many official bed bug complaints as there were four years ago, and nearly half result in violations.  It seems like bed bug cases are multiplying fast.  </p>
<p>Of course, for those who assume someone with bed bugs would call 311 to report them as a housing violation, those numbers might seem &#8220;manageable.&#8221;    My own observations suggest the vast majority do not call 311. </p>
<p>But the Observer clearly thinks there&#8217;s no cause to adjust your behavior in order to avoid bed bugs.</p>
<blockquote><p>Still, people like Emilia Rich, 28, of Greenpoint aren’t taking any chances. Her phobia started last year when two small red bumps appeared on her arm, and a co-worker suggested they could be from bedbugs (false alarm). Now she gets freaked out whenever she sees mattresses on the curb on garbage night, so much so that she walks to the other side of the street. As for furniture, she’s sticking with IKEA.</p>
<p>“Buying furniture at a stoop sale?” Ms. Rich said. “That’s not even an option!” </p>
</blockquote>
<p>Smart thinking, Emilia.  </p>
<p>You don&#8217;t have to live in a state of constant panic, but avoiding New York City stoop sales during the current bed bug crisis is probably a good idea.</p>
<p>Not having bed bugs when you think you do is good luck, but it hardly means you should not have some concerns about picking them up.</p>

			<content:encoded><![CDATA[<p><a href="http://www.recordonline.com/apps/pbcs.dll/article?AID=/20080603/NEWS/80603024">The Times Herald-Record, in Middletown, New York, reports</a> that Monticello Manor adult home has been shut down by the State of New York&#8217;s Department of Health:</p>
<blockquote><p>According to the state’s order, health department inspectors found violations of law “which constitute an imminent danger to the health, safety and welfare of the facility’s residents.”</p>
<p>The order says the building’s flat roof needs replacement, and that leaks have caused “severe structural degradation” and that the ceilings of six rooms have partially collapsed, plaster walls are peeling or bubbling, adjoining rooms and halls have water damage and steel ceiling support struts are rusting.</p>
<p>The order says “a foul smell of mold permeates the air. Water stains, mold and a generally moist environment are present,” and protection against the elements is “substantially compromised.”</p></blockquote>
<p>As you likely suspect by its mention here, yes, the conditions included a bad infestation of bed bugs:</p>
<blockquote><p><strong>On May 2, inspectors found live and dead bedbugs and bedbug eggs in 40 beds. Inspectors saw several residents with bedbug bites, who reported complaining to the adult home’s staff for months about the problem. No corrective action has taken place, the DOH said.</strong></p>
<p>The Health Department order suspends Monticello Manor’s operating license, and the state is preparing an order to permanently revoke the license and impose civil penalties on the operator, Charles Benson.</p></blockquote>
<p>All seventy residents are being relocated.  Forty beds contained &#8220;bed bugs and bed bug eggs&#8221;.<br />
<a href="http://bedbugger.com/2008/06/04/bed-bugs-and-the-elderly-a-story-from-st-paul"><br />
As in the case of Evie Kelly</a>, complaints about bed bugs were made and not acted on for some time (in the case of Monticello Manor, this went on for &#8220;months&#8221;).</p>
<p>And only &#8220;several residents&#8221; complained about bed bug bites.</p>
<p>Managers of adult residences (such as this one), dorms, senior housing, and other facilities need to be more proactive about bed bugs.  It is not sufficient to wait until <em>large numbers</em> of people come to complain. </p>
<p>This story reminds us that they won&#8217;t. </p>
<p><em>A few people</em> will come, and they will often represent huge numbers of people who may not be aware what is causing their problem, or may not be aware they have one, or who may fear repercussions for complaining about bed bugs.  </p>
<p>The complaints of those who do step forward <em>must</em> be taken seriously.  Bed bugs should be searched for aggressively, whenever someone comes forward to complain.  Because in so many of these cases, those complaints represent a fraction of the people affected by bed bugs.</p>

<p>As if falling and not being found for nearly a week was not enough of a horror story, <a href="http://www.nysun.com/new-york/injured-queens-woman-rescued-from-bug-infested/79164/"><br />
this news article in the Sun</a> focuses on the bed bug-infested state of her room.</p>
<blockquote><p>
EMS paramedics who responded were required to wear full-body suits to prevent contamination when they removed her from her room in the Baxter Hotel, a single-room occupancy hotel at 160 Beach 116th St.</p></blockquote>
<p>It is highly likely that other units in the building are also infested.</p>
<blockquote><p>[Building Superintendent Shawn] Reeder said he had not heard complaints of other infestations in the building. The owner of the building did not immediately return a call requesting comment.</p></blockquote>
<p>I hope that Ms. Kenny is feeling better soon.   </p>
<p>And I hope the Baxter Hotel gets a careful inspection&#8211;room by room.  And careful treatment where needed.  Bed bugs can happen anywhere, to anyone, of any age, but no one should have to live with them.</p>

<p><a rel="nofollow" href="http://www.newyorkshitty.com/?p=4795">Miss Heather</a> and <a rel="nofollow" href="http://newyorkvsbedbugs.org/2008/05/07/the-greenpoint-bed-bug-seminar-was-a-success/">Renee of New York vs. Bed bugs</a> both blogged about that terrifying (but as to be expected) situation.</p>
<p>Now <a href="http://www.nydailynews.com/news/2008/05/08/2008-05-08_now_were_bedbugged_in_subway-1.html">Pete Donoghue of the Daily News has picked up the story</a> via Miss Heather:</p>
<blockquote><p>Brownbear cited three stations where he believed bedbugs had, at least temporarily, bedded down: Hoyt-Schermerhorn, Union Square in Manhattan and Fordham Road in the Bronx.</p>
<p>A housing preservation and development spokesman cautioned that Brownbear, while more knowledgeable about bedbugs than the average person, is not a trained scientist or inspector.</p>
<p>NYC Transit spokesman Charles Seaton said the agency would check out the three hubs.</p></blockquote>
<p>Brownbear may not be a trained inspector, but he had bed bugs in his home for five months.  He is probably more qualified than many in the HPD to identify a scurrying bed bug.</p>
<p>I am concerned that they are only going to look at those three hubs.  NYC Transit employees should be taught to search for bed bugs, and doing so should be a routine occurrence in all trains and at all stations.</p>
<blockquote><p>Gene Russianoff of the Straphangers Campaign quipped: &#8220;Bedbugs on subway benches! Yet another reason not to fall asleep waiting for a train.&#8221;</p></blockquote>

The New York Post declares understatedly that &#8220;Bed Bugs Lurk Under Subway.&#8221; </a> If they were under the subway, however, we would not have to worry.  The problem is, they are <em>in</em> the subway:</p>

<p>Now that&#8217;s throwing the baby out with the bathwater!  Why not get rid of the bed bugs instead?</p>
<p>It is possible, you know.  But the first step is admitting we have a problem.</p>
<p>And <a href="http://www.myfoxny.com/myfox/pages/News/Detail?contentId=6492129&amp;version=6&amp;locale=EN-US&amp;layoutCode=TSTY&amp;pageId=3.2.1">Fox News shares videos of grossed out subway passengers</a> (though Fox claims this footage represents passengers&#8217; response to this news, this footage could have been stock &#8220;the subway is dirty&#8221; soundbites&#8211; bed bugs were not mentioned).</p>
<p>Perhaps in all the hysteria, New Yorkers will be reminded that we have politicians, we can demand they take action, and right now, the best way to channel that desire is to throw in your lot with New York vs. Bed Bugs.  <a href="http://newyorkvsbedbugs.org/2008/05/07/reminder-our-citizenspeak-campaign/">It only takes two minutes to make a difference.</a></p>

<p>But Bill A6667a later died in the NYS Senate in January of this year.</p>
<p>The good news is that the bill has now been amended and approved by the Assembly once again as A6667b. It has been submitted to the New York State Senate again as of 3/19, and is under consideration by their Education Committee.  <a href="http://assembly.state.ny.us/leg/?bn=A06667" title="NYS Assembly bill AO6667b">Click here to read the text of the bill and follow its progress through the NYS Assembly to Senate back to the Assembly, and now to the Senate again.</a></p>
<p>The bill,</p>
<blockquote><p>Requires city school districts having a population of one million or more to<br />
notify parents and persons in parental relation of any bedbug infestations<br />
found in a school.</p></blockquote>
<p>And as the <a href="http://assembly.state.ny.us/leg/?bn=A06667&amp;sh=t" title="text of AO6667">bill&#8217;s text details,</a> principals would need to notify parents right away and provide information on preventing infestations and on avoiding the spread of bed bugs from school to home (or vice versa):</p>
<blockquote><p> 1    Section 1. The education law is amended by adding a new section 920 to<br />
2  read as follows:<br />
3    S 920. PUBLIC SCHOOLS; INFESTATION OF BEDBUGS (CIMEX LECTULARIUS).  1.<br />
IN  A  CITY  SCHOOL  DISTRICT HAVING A POPULATION OF ONE MILLION OR MORE INHABITANTS, <strong>THE PRINCIPAL OF EACH PUBLIC SCHOOL SHALL PROVIDE IMMEDIATE NOTIFICATION TO ALL PARENTS OR PERSONS IN PARENTAL RELATION DISCLOSING A FINDING RELATING TO THE INFESTATION OF BEDBUGS  (CIMEX  LECTULARIUS)  IN SUCH SCHOOL. </strong>  ALONG WITH THE NOTIFICATION REQUIRED PURSUANT TO SUBDIVISION ONE OF THIS  SECTION,  <strong>THE  PRINCIPAL  OF SUCH PUBLIC SCHOOL SHALL ALSO INCLUDE INFORMATION REGARDING PROPER PROCEDURES TO PREVENT FURTHER  INFESTATIONS AT  THE SCHOOL AND TO PREVENT THE TRANSFER OF BEDBUGS FROM THE SCHOOL TO THE RESIDENCES OF STUDENTS.  </strong> SUCH INFORMATION MAY  BE  DEVELOPED  BY  THE BOARD OF EDUCATION IN CONSULTATION WITH OTHER CITY AGENCIES AND SHALL BE AVAILABLE IN VARIOUS LANGUAGES AS DEEMED NECESSARY. <strong>THE  PRINCIPAL  SHALL  ENSURE  THAT  THE BEDBUG INFESTATION AT THE SCHOOL IS PROPERLY ADDRESSED IN THE MOST EFFECTIVE AND SAFE MANNER.</strong></p></blockquote>
<p>Yes&#8211; it&#8217;s imperfect: why &#8220;one million or more&#8221;?<br />
But let&#8217;s not focus on that for now.</p>
<p>Instead, let&#8217;s consider that this is a big step forward.  We need the NY Senate to approve this bill.  Parents have a right to know if bed bugs are in their kids&#8217; schools.<br />
Let&#8217;s not let this bill die again in the Senate.</p>
<p>These are some education-minded NYS Assembly Members who sponsored AO6667b in the Assembly:</p>

<p>If your senators are on the Education Committee (and so listed right above), then tell them that you feel parents must be notified when bed bugs are found in school.</p>
<p><strong>Tell senators on the Education Committee that the bill matters because as the information on A6667b provided by the Assembly states, &#8220;Currently,  if a bed bug is discovered in a school, only the family of the affected child is notified.  Additional  notifications are left up to the discretion of school health officials.&#8221;  Tell them that requiring principals to notify parents promptly about bed bug infestations at school and requiring them to provide information about preventing the spread of bed bugs will help keep bed bugs out of our schools, and will also prevent other New Yorkers from suffering from the cost and pain of removing them from their homes or workplaces.   Minimizing the spread of bed bugs helps <em>everyone</em> in New York State.  </strong></p>
<p>If your senators are not on the Education Committee,<strong> </strong> drop them an email letting them know how affected you were by the bed bug problem, and how much you support Bill A6667b, currently being discussed by the Senate Education Committee.</p>
<p><strong>The bill died the first time it was considered by the NY State Senate.  Let&#8217;s make sure that does not happen again. </strong></p>
<p><strong>You can send good emails to three politicians in five minutes, using the information above.  <em>(In contrast, it took me an hour and a half to write this post and include all the links!) </em> Please contact your state senators, Assembly people.  We need to press politicians for change on the bed bug issue.<br />

<p>Kudos are now due to Renee of NewYorkvsBedbugs.org, <a href="http://newyorkvsbedbugs.org/2008/04/05/washpo-comes-clean/">who was surely the party responsible for convincing the Washington Post</a> via <a href="http://newyorkvsbedbugs.org/2008/04/04/make-it-right-washpo/">this campaign</a> to correct the erroneous information used by David Segal to dismiss the size of New York&#8217;s bed bug problem.</p>
<p>If you recall, <a href="http://www.washingtonpost.com/wp-dyn/content/article/2008/02/22/AR2008022202678.html">Segal argued that the media was overstating the size of the bed bug problem in the US.  To support this, Segal claimed that,</a></p>
<blockquote><p>. . . there are so many bedbug false alarms that there&#8217;s reason to assume many perfectly sane people are ringing them. In New York, the city housing authority has fielded and checked out more than 2,500 bedbug complaints in the past three years; fewer than 500 turned out to be actual infestations.</p></blockquote>
<p>That information was, of course, entirely incorrect, as well as misleading.</p>
<p><a href="http://www.washingtonpost.com/wp-dyn/content/article/2008/02/22/AR2008022202678.html" title="correction to segal article in washington post" rel="nofollow">The correction now preceding the article on the Washington Post&#8217;s site</a> reads,</p>
<blockquote><p><strong>Correction to This Article</strong><br />
The article about bedbugs said that 500 of the 2,500 bedbug complaints lodged with the New York City Housing Authority between 2005 and 2007 turned out to be actual infestations. After taking a closer look at its records, the authority now says it did not keep detailed reports on bedbugs until last year. Of the 1,720 bedbug complaints received in 2007, a spokesman says, 70 percent resulted in treatment by an exterminator.</p></blockquote>
<p>Nevertheless, my main complaint about the article still holds:  the information cited in the correction is still misleading.</p>
<p>Segal only chose to cite NYCHA data in his article.  The NYCHA only deals with infestations in <strong>public housing</strong>.  <a href="http://www.nyc.gov/html/nycha/html/about/factsheet.shtml" title="about NYCHA" rel="nofollow">As this NYCHA website reminds us, only 5.1% of the NYC population lives in NYCHA housing.</a>  Most tenants renting NYC apartments would not be eligible to call NYCHA to report a housing problem.</p>
<p>The vast majority of tenants in NYC would call the <a href="http://home2.nyc.gov/html/hpd/html/tenants/how_to_report.shtml" title="HPD how to report problems in an apartment" rel="nofollow">Housing and Preservation Department (HPD)</a> via the city&#8217;s 311 hotline, to report that a landlord was not dealing with a bed bug complaint.  I stress that they would <em>only</em> call 311 if (a) they lived in housing for which the landlord is reponsible for eliminating bed bugs (buildings of less than 3 units are one example of those which are apparently exempt), (b) they had tried to get the landlord to remedy the bed bug problem <em>and</em> it had not been dealt with, and (c) they were not afraid of any repercussions for reporting the landlord in this way.  (In fact, my anecdotal information suggests that most tenants with bed bugs in NYC don&#8217;t call 311; it&#8217;s also a given that zero homeowners would be included in this data, since HPD would not help them; so the HPD data is a <em>very</em> low estimate of how many tenants in NYC have bed bugs in a given year.)</p>
<p>Still, <a href="http://www.nydailynews.com/news/2007/12/30/2007-12-30_bedbug_epidemic_attacks_new_york_city.html" title="daily news on bed bugs" rel="nofollow">as the Daily News correctly reported last year</a>,  in the fiscal year ending June 2007, there were 6889 complaints of bed bugs reported to HPD and 2008 summonses handed out to landlords as a result.  Including this statistic along with the NYCHA data would lead to a fuller estimate of how many rental tenants had bed bugs in FY 2006-2007.  It would be woefully understated, but not as much as the data the Washington Post provides.</p>
<p>The Washington Post was right to correct the inaccuracy of the NYCHA data Segal offered up, but this correction does not fully correct the inaccuracy of the facts presented in support of Segal&#8217;s argument.</p>
<p>New Yorkers should visit NewYorkvsBedBugs.org and <a href="http://newyorkvsbedbugs.org/take-action/">write a letter to their city councilpersons</a>.<br />
Do it, and things might get better.</p>

<blockquote><p>For the last couple years New York City has been gripped in a panic over bedbugs. I mean you would think it’s the second coming of the 1932 Cholera epidemic the way people talk about them. Yet here were hundreds if not a thousand people wildly intermingling old dirty pillows, ripping them apart and then traipsing through their innards. You’d think this would be the bedbug equivalent of a 1000 person orgy without a single prophylactic. No one seemed concerned, but mark my words if the bedbug thing explodes in the next few months you can be damn sure it’ll be traced back to this.</p></blockquote>
<p>We don&#8217;t need to wait.  You can be sure that a pillow fight in Union Square would surely have included people who had bed bugs in their pillows and not a clue.</p>
<p>Numbers won&#8217;t spike significantly due to this, since they&#8217;re already very high.  But people will be bringing bed bugs to these parties.  Some will doubtless bring them home&#8211; after all that fun, I am sure taking steps to avoid bed bugs is the last thing on their minds.</p>

<p>I am sure anyone who&#8217;d consider participating in this would just think I was being paranoid or curmudgeonly, but I <em>really</em> don&#8217;t think this event is a good idea.</p>
<p>Nevertheless, it goes on:  according to the World Pillow Fight Day website, the 2008 pillow fights in Toronto and Montreal are set to be held when the weather is warmer.  San Francisco had theirs on Valentine&#8217;s Day:  way to spread the bed bug love.

<blockquote><p>In a ruling of first impression, a Manhattan judge has scratched a request for punitive damages in a bedbug case.</p>
<p>But the judge, Acting Supreme Court Justice Judith J. Gische, let go forward the negligence claims of two Maryland tourists for bites they sustained during a two-night stay at the theater district&#8217;s Milford Plaza.</p>
<p>The tourists, Debra Grogan and her adult daughter, Dana, are seeking $2 million in compensatory damages and an unspecified amount of punitive damages.</p>
<p>In rejecting their request for punitive damages, Justice Gische referred to a New York City Department of Health pamphlet in ruling that the two women had failed &#8220;to raise a triable issue of fact whether bedbugs are anything more than a nuisance.&#8221;</p></blockquote>
<p>It&#8217;s important to understand that the plantiffs are still able to proceed with their claims for $2 million in <em>compensatory</em> damages for negligence.  Only the request for <em>punitive</em> damages has been rejected.</p>
<p>What is interesting here is that in making this decision,  the judge apparently cited <a href="http://home2.nyc.gov/html/doh/html/vector/vector-faq1.shtml" title="nycdomhh pamphlet on bed bugs">the NYCDOMHH Bed Bug Fact Sheet</a>, which asks and answers questions about bed bugs, and says:</p>
<blockquote><p> <strong>ARE BED BUGS DANGEROUS?</strong></p>
<p>Although bed bugs are a nuisance, they are not known to spread disease.</p></blockquote>
<p>The plaintiff is suing the Milford Plaza and the Pest Control Operator with whom the Milford had a contract (PAC Extermination Services).    The Grogans stayed in a room infested with bed bugs that was near two rooms treated for bed bugs less than a month earlier, but which was itself not treated:</p>
<blockquote><p>Evidence in the case showed that three weeks before the Grogans&#8217; stay, the hotel had asked PAC to exterminate bedbugs in two rooms near the room reserved by the Grogans. Work orders had been issued for rooms 1511 and 1512 on Dec. 22, 2002. The Grogans stayed in room 1540 from Jan. 17 to Jan. 19, 2003.</p></blockquote>
<p>The Grogans&#8217; argument is backed up by an entomologist&#8217;s testimony that bed bugs travel from room to room:</p>
<blockquote><p>In support of their claims, the Grogans presented the affidavit of an expert in insects who teaches epidemiology and other courses at the University of Alabama School of Medicine.</p></blockquote>
<p>(It&#8217;s worth noting that although bed bugs are not currently known to spread disease, they are still the subject of study by an entomologist who teaches epidemiology in a medical school.)</p>
<blockquote><p>The entomologist, Robert J. Novak, reported that bedbugs can &#8220;easily&#8221; migrate from one room to another and that &#8220;proper eradication techniques&#8221; require inspection of &#8220;adjacent or contiguous rooms, or even rooms on several floors above and below&#8221; the floor where the pests had been spotted.</p>
<p>With the defendants having offered no affidavit to counter Dr. Novak&#8217;s assertions, Gische wrote, the Grogans had presented enough evidence that the hotel had &#8220;constructive notice&#8221; of the need to fumigate room 1540 to deny the defendants&#8217; motion for summary judgment.</p>
<p>The case must go to trial, Gische ruled, because Novak&#8217;s affidavit &#8220;set forth genuine issues of fact about the life span of bedbugs, how they migrate and whether these factors should have been (or were) taken into consideration by the defendants in how rooms were treated following bedbug complaints by other guests.&#8221;</p></blockquote>
<p>Even more interesting, this case may have ramifications for the ways PCOs treat for bed bugs.</p>
<blockquote><p>PAC Extermination Services had argued that it should be released from the case because its obligations were limited to completing work in specifics rooms the hotel had asked to be fumigate.</p>
<p>But Gische said a jury must decide whether the exterminator&#8217;s duties were so &#8220;comprehensive and exclusive&#8221; that it had assumed a duty to keep rooms, other than those for which it received work orders, in &#8220;a reasonably safe condition.&#8221;</p></blockquote>
<p>We often hear from PCOs who treat buildings that landlords will ask them to treat just the infested room or rooms, and will often refuse to have other adjacent units on the same or other floors inspected.  I can only assume that many hotel managers will make the same request.</p>
<p>In such a case, it&#8217;s my understanding that PCOs have two choices: refuse the job (knowing some other PCO will be happy to do as the landlord asks), or do the job, knowing it is likely not enough.  This is not an easy choice to make, by any means.</p>
<p>Depending on the court&#8217;s findings in this case, we may see a change in this.  It may mean more PCOs refuse to treat under such circumstances, insisting instead that adjacent and nearby units are inspected and/or treated.</p>
<p>It could also have ramifications for the price of treatment, since it will doubtless lead to more litigation along the same lines.</p>
