Winnipeg HoJo gets sued over bed bugs

A Toronto man is suing a Winnipeg Howard Johnson’s motel, claiming he was bitten by bed bugs there.

CJOB in Manitoba reports,

A Toronto man has filed a civil suit against the Howard Johnson Hotel on Ellice Avenue alleging he caught a case of the bed bugs while rooming at the establishment.

Steven Lipson claims after a one-night stay at the hotel in January 2007 he developed welts and itchiness. Lipson alleges a dermatologist confirmed he was bitten by bed bugs. He is suing the Howard Johnson for damages claiming he suffered pain, embarrassment, and permanent scarring.

There isn’t much to chew on there, but we don’t often hear about Canadian bed bug lawsuits, so it does feel quite newsworthy.

Oct 9th of 2008 I stayed at the Drury Hotel in Greenville, Ohio. Oct 10 my back was covered by bites, Oct. 11th My arms, legs neck, scamp, feet and over the front of my body all were covered in bites.
I checked out early to drive back home 3 hrs. to return home to visit my doctor.
I called the general manager who returned my call the following day saying there was bed bugs in the bed I was sleeping in.

I suffered with these bites until Feb 2009 when my dermatologist finally found something to kill them. After the exterminator has come by three times to spray twice and fog the bedroom he wrote me a letter suggesting I get a new mattress, which I can’t afford. I’ve slept in the guest room since that time.

The Drury’s insurance company say’s they’ll only re-imburse me of doctors and medication. My feelings are that I suffered with these bits plus the new ones that continued to appear.
These bites itched so badly that itching caused bleeding for months.

I live in a small town with no attorneys that would specialaize in this type law suit.
Can you give me some suggestions on who I should look for and if I do have a case for the suit?

Your best bet is probably to read the articles linked from this FAQ about lawsuits, and contact one of the lawyers mentioned.

Sorry I can’t be more help. I am not a lawyer and don’t know much about this.
